Data collection on this website

Who is responsible for collecting data on this website?

Data processing on this website is carried out by the website operator. You can find its contact details in the section “Information about the controller” in this privacy policy.

How do we collect your data?

Some of your data is collected when you provide it to us. This may include data that you enter in a contact form, for example.

Other data is collected automatically, or with your consent, by our IT systems when you visit the website. This is primarily technical data (e.g. your internet browser, operating system or the time you access a page). This data is collected automatically as soon as you enter this website.

What do we use your data for?

Some data is collected to ensure that the website is provided without errors. Other data may be used to analyse how you use the website.

What rights do you have concerning your data?

You have the right at any time to obtain, free of charge, information about the origin, recipients and purpose of the personal data we store about you. You also have the right to request the correction or deletion of this data. If you have given consent to data processing, you may withdraw that consent at any time with effect for the future. In certain circumstances, you also have the right to request the restriction of the processing of your personal data. You furthermore have the right to lodge a complaint with the competent supervisory authority. You may contact us at any time about this or any other questions concerning data protection.

When you visit this website, your browsing behaviour may be statistically analysed. This is done primarily using analytics programs. Detailed information about these analytics programs can be found in the following privacy policy.

Hosting

We host the content of our website with the following provider: External hosting

This website is hosted externally. Personal data collected on this website is stored on the server or servers of the hosting provider or providers. This may include, in particular, IP addresses, contact requests, metadata and communications data, contract data, contact details, names, website access data and other data generated through a website. External hosting is used for the purpose of fulfilling contracts with our prospective and existing customers (Art. 6(1)(b) GDPR) and in our interest in having a professional provider make our online offering available securely, quickly and efficiently (Art. 6(1)(f) GDPR). Where corresponding consent has been requested, processing is carried out exclusively on the basis of Art. 6(1)(a) GDPR and Section 25(1) TDDDG, insofar as the consent covers the storage of cookies or access to information on the user’s terminal equipment (e.g. device fingerprinting) within the meaning of the TDDDG. Consent may be withdrawn at any time.

Our hosting provider or providers will process your data only to the extent necessary to fulfil their service obligations and will follow our instructions concerning that data.

We use the following hosting provider:

Vercel Inc.
440 N Barranca Avenue #4133
Covina, CA 91723
USA

Vercel may process personal data in the USA and other countries. To the extent that Vercel acts as a processor on our behalf under the plan we use, processing is based on a data processing agreement pursuant to Art. 28 GDPR. For transfers to third countries, Vercel provides for the transfer mechanisms described in its Data Processing Addendum, in particular the European Commission’s Standard Contractual Clauses. Further information is available at https://vercel.com/legal/dpa and https://vercel.com/legal/privacy-notice.

General information and mandatory disclosures

Data protection

The operators of these pages take the protection of your personal data very seriously. We treat your personal data confidentially and in accordance with statutory data protection regulations and this privacy policy.

When you use this website, various items of personal data are collected. Personal data is data that can be used to identify you personally. This privacy policy explains what data we collect and what we use it for. It also explains how and for what purpose this happens.

We point out that data transmission over the internet (e.g. communication by email) may be subject to security vulnerabilities. It is not possible to provide complete protection against third-party access to data.

Information about the controller

The controller responsible for data processing on this website is:

Varian Energy GmbH
Rheinallee 8
41460 Neuss

Phone: +49 160 9242 9942
Email: info@varian-energy.com

The controller is the natural or legal person who, alone or jointly with others, determines the purposes and means of processing personal data (e.g. names, email addresses or similar information).

Storage period

Unless a more specific storage period is stated in this privacy policy, your personal data will remain with us until the purpose for processing it no longer applies. If you submit a legitimate request for deletion or withdraw your consent to data processing, your data will be deleted unless we have other legally permissible grounds for storing your personal data (e.g. retention periods under tax or commercial law); in the latter case, deletion will take place once those grounds cease to apply.

General information about the legal bases for data processing on this website

If you have consented to data processing, we process your personal data on the basis of Art. 6(1)(a) GDPR or Art. 9(2)(a) GDPR if special categories of data within the meaning of Art. 9(1) GDPR are processed. In the event of express consent to the transfer of personal data to third countries, data processing is also based on Art. 49(1)(a) GDPR. If you have consented to the storage of cookies or to access to information on your terminal equipment (e.g. through device fingerprinting), data processing is additionally based on Section 25(1) TTDSG. Consent may be withdrawn at any time. If your data is necessary to fulfil a contract or to take steps prior to entering into a contract, we process your data on the basis of Art. 6(1)(b) GDPR. Furthermore, we process your data on the basis of Art. 6(1)(c) GDPR if this is necessary to fulfil a legal obligation.

Data processing may also be based on our legitimate interest under Art. 6(1)(f) GDPR. The legal bases applicable in each individual case are explained in the following paragraphs of this privacy policy.

Information on data transfers to the USA and other third countries

Among other things, we use tools from companies based in the USA or in other third countries that are not considered safe under data protection law. When these tools are active, your personal data may be transferred to and processed in those third countries. We point out that a level of data protection comparable to that in the EU cannot be guaranteed in these countries.

For example, US companies are required to disclose personal data to security authorities without you, as the data subject, being able to challenge this in court. It therefore cannot be ruled out that US authorities (e.g. intelligence agencies) may process, analyse and permanently store data about you held on US servers for surveillance purposes. We have no influence over these processing activities.

Withdrawal of your consent to data processing

Many data processing operations are possible only with your express consent. You may withdraw consent you have already given at any time. Withdrawal does not affect the lawfulness of data processing carried out before the withdrawal.

Right to object to data collection in specific cases and to direct marketing (Art. 21 GDPR)

IF DATA PROCESSING IS BASED ON ART. 6(1)(E) OR (F) GDPR, YOU HAVE THE RIGHT AT ANY TIME TO OBJECT, ON GROUNDS RELATING TO YOUR PARTICULAR SITUATION, TO THE PROCESSING OF YOUR PERSONAL DATA; THIS ALSO APPLIES TO PROFILING BASED ON THOSE PROVISIONS. THE RESPECTIVE LEGAL BASIS ON WHICH PROCESSING IS BASED CAN BE FOUND IN THIS PRIVACY POLICY. IF YOU OBJECT, WE WILL NO LONGER PROCESS THE PERSONAL DATA CONCERNED UNLESS WE CAN DEMONSTRATE COMPELLING LEGITIMATE GROUNDS FOR THE PROCESSING WHICH OVERRIDE YOUR INTERESTS, RIGHTS AND FREEDOMS, OR THE PROCESSING IS NECESSARY FOR THE ESTABLISHMENT, EXERCISE OR DEFENCE OF LEGAL CLAIMS (OBJECTION UNDER ART. 21(1) GDPR). IF YOUR PERSONAL DATA IS PROCESSED FOR DIRECT MARKETING, YOU HAVE THE RIGHT AT ANY TIME TO OBJECT TO THE PROCESSING OF PERSONAL DATA CONCERNING YOU FOR THE PURPOSE OF SUCH MARKETING; THIS ALSO APPLIES TO PROFILING INSOFAR AS IT IS RELATED TO SUCH DIRECT MARKETING. IF YOU OBJECT, YOUR PERSONAL DATA WILL THEREAFTER NO LONGER BE USED FOR DIRECT MARKETING PURPOSES (OBJECTION UNDER ART. 21(2) GDPR).

Right to lodge a complaint with the competent supervisory authority

In the event of breaches of the GDPR, data subjects have the right to lodge a complaint with a supervisory authority, in particular in the Member State of their habitual residence, place of work or the place of the alleged breach. The right to lodge a complaint is without prejudice to any other administrative or judicial remedy.

Right to data portability

You have the right to receive data that we process by automated means on the basis of your consent or in fulfilment of a contract, or to have it transferred to a third party, in a commonly used, machine-readable format. If you request that the data be transferred directly to another controller, this will be done only where technically feasible.

Access, rectification and erasure

Within the framework of the applicable statutory provisions, you have the right at any time to obtain, free of charge, information about the personal data we store about you, its origin and recipients, and the purpose of data processing, and, where applicable, the right to have that data corrected or deleted. You may contact us at any time about this or any other questions concerning personal data.

Right to restriction of processing

You have the right to request restriction of the processing of your personal data. You may contact us at any time to do so. The right to restriction of processing applies in the following cases:

  • If you contest the accuracy of the personal data we store about you, we generally need time to verify it. For the duration of the verification, you have the right to request restriction of the processing of your personal data.
  • If the processing of your personal data was or is unlawful, you may request restriction of processing instead of erasure.
  • If we no longer need your personal data, but you need it for the establishment, exercise or defence of legal claims, you have the right to request restriction of processing instead of erasure.
  • If you have objected under Art. 21(1) GDPR, your interests and ours must be balanced. Until it has been determined whose interests prevail, you have the right to request restriction of the processing of your personal data.
  • If processing of your personal data has been restricted, that data may, apart from being stored, be processed only with your consent or for the establishment, exercise or defence of legal claims, to protect the rights of another natural or legal person, or for reasons of important public interest of the European Union or a Member State.

SSL or TLS encryption

For security reasons and to protect the transmission of confidential content, such as orders or enquiries that you send to us as the website operator, this site uses SSL or TLS encryption.

You can recognise an encrypted connection when the address line of your browser changes from “http://” to “https://” and a padlock symbol appears in your browser.

When SSL or TLS encryption is enabled, the data you transmit to us cannot be read by third parties.

Data collection on this website

Contact form

If you send us an enquiry via the contact form, we store the information you provide in the enquiry form, including the contact details you enter there, in order to handle your enquiry and any follow-up questions. We use an email service for the technical delivery of your enquiry to us; details can be found below.

This data is processed on the basis of Art. 6(1)(b) GDPR if your enquiry relates to the performance of a contract or is necessary to take steps prior to entering into a contract. In all other cases, processing is based on our legitimate interest in effectively handling enquiries addressed to us (Art. 6(1)(f) GDPR) or on your consent (Art. 6(1)(a) GDPR), where such consent has been requested; consent may be withdrawn at any time.

The data you enter in the contact form will remain with us until you ask us to delete it, withdraw your consent to its storage or the purpose for storing the data no longer applies (e.g. once your enquiry has been dealt with). Mandatory statutory provisions, in particular retention periods, remain unaffected.

Project enquiries via the contact form

When you submit our project enquiry form, we process the project topic, your name, email address and message, as well as your company and telephone number if provided. The information is sent to an endpoint on this website, checked there for technical validity and then delivered to Varian Energy via the Resend email service. Your email address is used as the reply-to address.

The email service provider is Plus Five Five, Inc. (Resend), 2261 Market Street #5039, San Francisco, CA 94114, USA. In providing the service on our behalf, Resend processes, in particular, email addresses, message content and technical delivery and metadata. This website does not additionally store the enquiry in its own database; however, the message we receive is stored in our email inbox so that we can handle your enquiry.

Processing is based on Art. 6(1)(b) GDPR to the extent that your enquiry concerns steps prior to entering into a contract or the performance of a contract. In all other cases, it is based on Art. 6(1)(f) GDPR; our legitimate interest is the efficient and reliable handling of incoming enquiries. An agreement on processing personal data exists with Resend under its terms. For transfers to the USA, Resend provides for the European Commission’s Standard Contractual Clauses in particular and also states that it participates in the EU-U.S. Data Privacy Framework. Further information is available at https://resend.com/legal/dpa and https://resend.com/legal/privacy-policy.

Appointment requests via this website

When you request an appointment, we process the project type, preferred date and time, your name, company and email address, and, if provided, your telephone number, location and message. The information is sent to an endpoint on this website and checked there for technical validity. If the email service is configured, the request is sent to Varian Energy via Resend; your email address is used as the reply-to address. If the email service is not configured, the website instead opens a prepared email in your email application. In that case, the website does not transmit the data to Varian Energy unless you send the prepared email yourself. An appointment request becomes a confirmed appointment only after we expressly confirm it.

The website does not additionally store appointment requests in its own database. If the request is sent via Resend, the information about Resend above applies accordingly. The message we receive is stored in our email inbox so that we can handle it. The legal basis is Art. 6(1)(b) GDPR insofar as the request relates to steps prior to entering into a contract or to a contract; in other cases, it is Art. 6(1)(f) GDPR (our legitimate interest in efficiently handling the request). The data is deleted once the purpose of processing no longer applies and no statutory retention obligations or other legitimate grounds for storage remain.

Enquiries by email, telephone or fax

If you contact us by email, telephone or fax, your enquiry, including all personal data arising from it (name, enquiry), will be stored and processed by us for the purpose of handling your request. We do not share this data without your consent.

The data you send us in connection with a contact enquiry will remain with us until you ask us to delete it, withdraw your consent to its storage or the purpose for storing the data no longer applies (e.g. once your enquiry has been dealt with). Mandatory statutory provisions, in particular statutory retention periods, remain unaffected.

Plugins and tools

Cookies and similar technologies

When Google Maps is embedded, Google may use cookies or similar technologies and read information already stored on your device. The map on our contact page loads only after you consent to Google Maps in the privacy settings or select “Load Google Maps”. Vercel Web Analytics also loads only with your consent and, according to Vercel, does not use cookies. Your choice (essential functions, analytics and Google Maps) and its timestamp are stored locally in your browser and requested again after six months. You can change or withdraw it at any time through “Privacy settings” in the footer. Cloudflare Turnstile processes security information that is technically necessary to detect automated access; further information is provided in the “Cloudflare Turnstile” section.

Google Fonts (hosted locally)

This site uses Google Fonts, provided by Google, to display fonts consistently. The Google Fonts are installed locally. No connection to Google servers is made for this purpose. Further information about Google Fonts is available at https://developers.google.com/fonts/faq and in the Google privacy policy: https://policies.google.com/privacy?hl=de.

Google Maps

This site uses the Google Maps mapping service. The provider is Google Ireland Limited (“Google”), Gordon House, Barrow Street, Dublin 4, Ireland. The map on our contact page does not load automatically, but only after you consent to Google Maps in the privacy settings or select “Load Google Maps”. Only then is a connection to Google established. In particular, your IP address, the page you visit and technical information about your browser and device may be transmitted to Google. Google may use cookies or similar technologies or read information already stored on your device.

Google Maps is activated on the basis of your consent under Art. 6(1)(a) GDPR. To the extent that Google stores information on your device or accesses information already stored there and consent is required for this, the legal basis is Section 25(1) TDDDG. You may withdraw your consent with effect for the future. No Google Maps content is loaded without your consent. Withdrawing consent in the privacy settings removes the embedded map for future use.

Processing of data by Google in the USA or other third countries cannot be ruled out. Google LLC states that it participates in the EU-U.S. Data Privacy Framework; it also states that it uses Standard Contractual Clauses where necessary. Further information is available at https://policies.google.com/privacy/frameworks?hl=de and https://policies.google.com/privacy?hl=de.

Vercel Web Analytics

With your consent, this website uses Vercel Web Analytics, a service provided by Vercel Inc., to statistically analyse page views and improve our online offering. According to Vercel, Web Analytics does not use cookies and stores only anonymised or aggregated analytics data. A hash is generated from the incoming request to distinguish visitors; it is valid for only one day and is then reset. Vercel states that the data collected is not used to track visitors across different websites or days and is not linked to an individual person or IP address.

Processing takes place only with your consent under Art. 6(1)(a) GDPR. You can withdraw consent at any time through “Privacy settings” in the footer with effect for the future. The provider is Vercel Inc., 440 N Barranca Avenue #4133, Covina, CA 91723, USA. Further information about the nature and scope of processing is available at https://vercel.com/docs/analytics/privacy-policy and https://vercel.com/legal/privacy-notice.

Cloudflare Turnstile

If spam protection is enabled on a form, we use Cloudflare Turnstile. The provider is Cloudflare, Inc., 101 Townsend St., San Francisco, CA 94107, USA. Turnstile is used to detect automated or abusive form submissions and to protect our website and the forms it provides.

According to Cloudflare, Turnstile processes only the signals necessary for the security check. These may include, in particular, the client IP address, TLS fingerprint, user-agent header, the sitekey used and the associated origin of the request. Turnstile generates a verification token that our server validates with Cloudflare via the Siteverify interface. Depending on the technical configuration, the visitor’s IP address may also be transmitted to Cloudflare during this server-side check. According to Cloudflare, the contents of the form fields you complete are not processed as part of the Turnstile check.

The legal basis is Art. 6(1)(f) GDPR. Our legitimate interest is in protecting our forms and IT systems against spam, automated attacks and other misuse. To the extent that Turnstile stores or reads technically necessary information on your device, we consider this necessary to provide the website security function you have expressly requested and therefore based on Section 25(2) no. 2 TDDDG. Cloudflare states that it processes certain signals as a processor to provide Turnstile and other signals as an independent controller to improve bot detection.

Further information is available in the Turnstile Privacy Addendum and the Cloudflare Privacy Policy.
